By using the irietones.com website you agree to the following terms

We can only accept orders and personal information from those 18
years old or older. If you are under 18 years of age, you can use
this site with a friend, parent, or guardian who is 18 years old

PRIVACY

COMMUNICATION
When you attempt to communicate with us, we will do our best to
respond to you. You consent to receive these communications from

sell products for children, but it must sell them to adults. If

DISCLAIMER OF LIABILITY
Irie Tones Music is not liable for any damages including damages
to your self or your computer arising from the use of this site
including, but not limited to, viruses, files, or any other content.
Irie Tones Music is also not liable for any harm caused to you or
any other person or property arising from the use of the products

SITE POLICIES AND MODIFICATION

DISPUTES
Any dispute relating in any way to your visit to irietones.com or
to products you purchase through Irie Tones Music shall be submitted
to confidential arbitration in Salt Lake City, UT. Arbitration under
this agreement shall be conducted under the rules then prevailing
of the American Arbitration Association. The arbitrator's award
shall be binding and may be entered as a judgment in any court of
competent jurisdiction. To the fullest extent permitted by applicable
law, no arbitration under this Agreement shall be joined to an arbitration
involving any other party subject to this Agreement, whether through
class arbitration proceedings or otherwise.

is wrong, and those who do should be physically punished. If you

Irie Tones Music does collect information from its users - we have
to in order to sell you the products you want. But we assure you
that any information you provide to Irie Tones Music will be used
only as you expect – to sell you the best authentic African
drums and accessories at the lowest prices. We only collect information
relevant to your shopping experience. In fact, you may browse the
site without giving us any personal information at all. You will
only be asked to provide information when you start the checkout
process or when you sign up for a reseller or affiliate account.
We may ask you for any of the following information: name, organization
(if applicable), shipping address, billing address, billing information
(such as a credit card number, expiration date, etc. as applicable),
and your communications preferences. Information that is optional
will be noted. We only use the information we collect to process
your orders, manage your reseller or affiliate account, or send
you information that you have specifically requested. We don’t
customize your experience based on information we receive.

PRODUCT DESCRIPTIONS
Irie Tones Music always attempts to be as accurate as possible when
describing products. However, Irie Tones does not warrant that product
descriptions or other content of this site is accurate, complete,
reliable, current, or error-free. If you receive a product from
Irie Tones Music or irietones.com and you believe it is not as described,
you may return subject to our Return Policy.
PRODUCT IMAGES
All product images on irietones.com are actual pictures taken by
Irie Tones Music of the Irie Tones products being sold. Images may
be adjusted for the sole purpose of enhancing image quality but
will never be manipulated to change the appearance of the product.
In all cases the images shown on a product page are for display
only and do not constitute a description of the item that will be
received. Please read the product description carefully and follow
relevant links to fully understand the contents and attributes of
an item.
COLORS
Many of the products on the Irie Tones Music website are colored
(fabric or instruments). Due to differences in monitors, video cards,
and visual perception Irie Tones Music cannot guarantee any colors.
And because each item is hand crafted no two items will be completely
identical. If you are not happy with the color of your item you
may return it subject to our Return Policy.
AVAILABILITY
Irie Tones Music maintains on-hand inventory of many of our most
popular items. However, availability of any item may change at any
time and is subject to change without notice. If you place an order
and a product is not immediately available then a representative
will contact you to inform you of the situation and try to meet
your needs. Irie Tones Music will never process your order (including
charging your credit card) if an item is not immediately available.
- In stock - Buy Now!: The product is on hand and available
for shipment immediately. Usually ships within 24 hours of payment.
- Out of Stock:: We have recently sold out of
this particular item, but it is on order with the vendor. The ETA (estimated time of arrival) gives our best approximation of when it will become available in our store. Please contact us if you would like to inquire for more details about availability of specific items.
- Special Order: This is a custom-made African
product or a very rare item. We place an order for this item when
you place your order. It is difficult to estimate how soon you
will receive your item because there are so many variables out
of our hands; our African partners deal with logistical mishaps
continually and do their best to overcome. We will work hard to
get your products to you as soon as possible, and will keep you
updated as to the status. Generally special order items will be available from within 3 to 8 weeks.

MONEY BACK GUARANTEE AND 90-DAY
WARRANTY
MONEY BACK GUARANTEE: Irie Tones wants you to be completely satisfied
with your purchase, and make every effort to provide quality instruments
and accessories that you will be more than pleased with. However,
we do understand that it can sometimes be worrisome to purchase
musical instruments site unseen. In order to eliminate your concerns
we offer a conditional money back guarantee on all of our products
except for media items (books, CDs, DVDs, videos, etc.). If you
are not satisfied with your products you should contact
us immediately and return the item(s) within 3 days of
receipt. After the items have arrived at our offices and have
been inspected we will provide a refund of the purchase price of
the item (no outbound or return shipping refunds, sorry). In order
for you to receive the full refund amount the item must not have
any visible signs of use or wear, and must not be damaged. Your
refund will either be credited back to your credit card or you will
be issued a company check, at the discretion of Irie Tones, allowing
2 weeks after the item has arrived back to us for refund processing.
If you fail to contact us within 3 days or receipt of item and return
it within 10 days you will not be eligible for the money back guarantee,
at which time the 90-day warranty and return policies apply.
90-DAY WARRANTY: Our drums and accessories are crafted with care
by experienced artisans and manufacturers, with durability and playability
in mind. However, in rare instances something may have a defect,
which is why we provide a 90-day warranty to the end-consumer on
all of our drums, instruments, and accessories, excluding media
items (books, CDs, DVDs, videos, etc.). Unless specified elsewhere,
all warranties cover product quality and craftsmanship only and
do not cover abuse, neglect, and damages caused by any person or
incident. Damages or losses incurred during shipment are excluded
from this warranty. See Shipping Policies for more information.
POST-WARRANTY SUPPORT: We want you to be happy with your Irie Tones
product long after the 90-Day Warranty has expired. We are drummers,
and we are consumers just like you, and expect to be dealt with
fairly in all respects. This is why we want to make ourselves available
to you for any African drum needs you may have. Call us anytime
with questions or for recommendations - we'll even pay for it when
you dial our toll-free number! When the time comes to replace the
head, we have discounted
repair services available for Irie Tones customers. Whatever
the need, you can count on us to make every effort to be of assistance.
Note on Wood Splits: Because wood is a
hygroscopic material it will readily take up and release water,
depending on its environment. As the wood releases water to match
a dryer environment, the cells contract, beginning on the surface
and working in. Conversely, as moisture is absorbed the wood expands.
This process will occur to some degree every time the wood is
relocated to a different environment, may last for several months,
and is affected by temperature. This absorption and release of
water does not occur uniformly, which may cause the wood to warp,
split, or honeycomb. Although our village artisans and Irie Tones
take precautions to prevent this, there is no way to avoid it
altogether. Your drum may come with or develop small vertical
splits or cracks in the base, neck, or belly. In some cases minor
splits will have been repaired, which, although they may be visible,
they do not have any sound or playability effects, and do not
constitue a manufacturing defect. In rare cases a split may develop
that extends all the way through the wood, in which case we encourage
you to contact us.
Note on Skin Splits: Unless a drum is sold
with a beater or mallet (dunun and talking drum) it is intended
to be played only with bare hands. Djembes, in particular, are
made with a relatively thin goat skin that is under very high
tension. If struck even softly with any kind of mallet it will
likely break. We have enough experience to know what skins look
like that have broken under natural stress or appropriate use,
and which have been misused or struck with a beater. We do not
offer refunds or exchanges on drums or skins that have been used
improperly, which jugement is at our discretion after seeing the
item. We do offer repair
services, with discounts for Irie Tones instruments.

PRICING STRUCTURE
Irie Tones Music uses a scaled price structure that offers lower
prices for higher quantity. We do this because we want to make it
possible for customers who buy in bulk to resell our products with
a reasonable profit margin. If we were to consistently sell individual
items at our lowest price then we would be hurting our own customers.
We also want to make chess equipment more affordable for organizations
and individuals.
THE PRICE TABLE
Irie Tones Music uses a price table to show you our prices based
on quantity. The number in the shaded cells above is the minimum
quantity necessary to qualify for the price shown directly below.
In the example table below, 3 units would cost $119.95 each while

PRICE MATCHING
Irie Tones Music will, at its discretion, match prices with any
other retail or web store. However, please note that not all handcrafted
goods, especially drums, are the same even though they may look
the same or have the same name. We do our best to carry the best
products at the best prices. If you would like us to match a price,
please contact us.
CUSTOM PRICING
Irie Tones Music reserves the right to change its prices for any
customer at any time. We may lower prices based on overall volume
or other special circumstances.

Purchase Orders

Irie Tones accepts purchase orders from verifiable businesses, organization, and schools within the United States. To place a purchase order you can do one of the following:
- Place the order through our website by adding items to the shopping cart and selecting "Purchase Order" as your method of payment. You will then be navigated through a form that requests information such as Accounts Receivable contacts, addresses, and so forth. Before we can accept the purchase order the individual placing the order must accept responsibility for helping to make sure the purhcase order is paid in a timely manner.

- Fax us your purchase order on 801-746-8343. We'll phone the contact person to verify the order.
return POLICY

Irie Tones Music wants you to be happy with your purchase. However,
we understand that there are circumstances that warrant a replacement
or exchange. Please read the following terms carefully. In any case, phone us immediately if products arrive damaged, and retain all packing materials, and phone first if for any reason you are not satisfied.
RETURNING ITEMS
You will be responsible for the shipping costs to return any item,
either for exchange or replacement. However, you will be credited
all reasonable freight charges relevant to that item if the product
is damaged or defective, or the wrong item was shipped. This does
not include exchanges based on a dislike of color, sound, craftsmanship,
or misunderstanding of product descriptions. You must include the
original postal receipt in your return package to be eligible for
a credit. Contact us if you have any questions about any product
we carry.
CONDITION OF RETURNED ITEMS
All items returned for exchange must be in a new or saleable condition.
Items that are returned and non-saleable due to use or damage will
not be accepted and will be returned to sender. The only exception
to this rule is for warranty
returns (see both Product Policy and the following terms for more
information).
REPLACEMENTS AND EXCHANGES
All approved warranty returns will be replaced with an item of equal
or lesser value of your choice. Non-warranty returns may be exchanged
for an item of equal or lesser value of your choice, a maximum of
one time per customer. See RETURNING ITEMS above for details regarding
reimbursement of shipping costs. In any case, Irie Tones will pay
for the freight charges to send your replacement or exchange item
to you. Irie Tones cannot offer cash refunds for items once purchased,
regardless of the reasons for the exchange or replacement, and apologize
for any inconvenience this may cause.
TIMEFRAME FOR RETURNS
You may return any product for an exchange within 30 days of receipt
of the product. This time frame begins the day you receive the product
and ends the day you ship the product back. You may return any item
for replacement covered by warranty subject to the warranty policy.
SPECIAL EXCEPTIONS
Irie Tones Music cannot accept returns of any instructional media
once it has been opened. No exceptions.
HOW TO MAKE A RETURN
If you have any questions about making a return please contact Irie
Tones Music first. Please include all original packaging, a note
explaining the return, and return freight receipt. All returns must
be mailed to:

lost or damaged in the return freight. You must deal directly with
the freight company you used. Irie Tones Music will do its best

FREIGHT SERVICES
Irie Tones Music uses UPS for the majority of domestic and Canadian
shipments, large and small. We offer Ground, 3 Day Select, 2 Day,
and Next Day services. We use USPS for shipments outside of the
US and Canada, offering only economy air and economy surface. We
may at our discretion use other shippers as well (including FedEx,
DHL, the USPS, and other freight forwarders).
FREIGHT CHARGES
You will be charged the exact amount shown in your shopping cart.
For some orders (including orders that exceed a certain weight)
you may need to place your order via phone in order for us to custom
quote your shipping charges. All of our shipping prices are actual
shipping costs plus a small percentage of the total order price
to cover materials. Occassionally a larger order will require a
custom price quote that cannot be calculated through the shopping
cart; in these cases we may phone you to authorize additional shipping
charges.
INTERNATIONAL SHIPPING
We are pleased to offer shipping to destinations outside of the US for most items. In some cases maximum parcel size restrictions may prevent us from being able to ship an item to a certain destination. We'll let you know if we encounter any restrictions on shipping with your order. You should be prepared to pay some additional amount to your government or postal system in the form of import duties, customs fee, or brokerage charges if the package crosses an international border to get to you after it leaves our offices in the US. We have no way of knowing what these charges will be, if any, nor can we collect these charges from you in advance. The shipping charge we require of you is to package and ship the package, but does not include these additional, separate charges for customs or import taxes.
SHIPPING ERRORS
Your total shipping costs will be exactly those shown on the shopping
cart web page. If you are not given a shipping quote on the website
(due to shipping to a country not on our list, or ordering more
than 150 pounds of merchandise) than you will be contacted via email
or telephone for a price quote. Regardless of where you receive
your shipping quote, you will be charged that amount for shipping
and there will be no refunds given based on a misunderstanding of
shipping. If you ask for Next Day Air, we will ship Next Day Air
and you will be billed for Next Day Air and cannot claim that you
did not know how expensive it is. This is the same for all shipping
methods. If we ship the wrong item to you, contact us so we can
send you a return shipping slip, and we'll make sure you get the
right product. (see RETURN POLICY
).
TIMEFRAME
Irie Tones Music will, unless otherwise noted, ship your order within
1 business day (Mon-Fri) of payment. If we cannot ship your order
within 1 business day we will make a reasonable effort to contact
you. Your order will not be processed or shipped if the entire order
is not immediately available.
EXPEDITED SHIPMENTS
If you need an expedited shipment please call us immediately and
we will do our best to accommodate you.
INSURANCE
All shipments made from Irie Tones Music are insured for the value
of the contents. Irie Tones Music will not be held liable for any
inconvenience or loss caused by loss or damage during shipment (see
WARRANTY). Please contact Irie
Tones Music to coordinate efforts and to support your claims against
damaged or lost packages.
NOTIFICATION
Irie Tones Music will provide you with a tracking number at your
request, if available.

PROCESSING ORDERS
If you complete the checkout process on an order we will consider
that you fully intend to proceed with that order. We will process
your order within 1 business day. Please do all of the research
and ask all of the questions you need before you order.
RECEIPT
A receipt will be emailed to you after your order is processed.
We generally do not include paper receipts in our orders. If you
would like a paper receipt please make note in your order comments.
ORDER NOTIFICATION
You will be immediately notified if Irie Tones Music cannot, for
any reason, process your order.
CANCELLING ORDERS
Irie Tones Music processes orders as quickly as possible. If you
need to cancel an order please do so immediately via email and phone.
We may or may not be able to cancel your order before it ships.
If your order ships than it may only be returned as subject to our
return policy.
PAYMENT METHODS
Irie Tones Music accepts the following credit cards: Visa; MasterCard;
American Express. Irie Tones Music also generally accepts checks
and money orders that clear the bank. PayPal payments are also accepted,
which should be directed to ebay@irietones.com. Irie Tones
Music may also decide, at its discretion, to accept purchase orders
from verifiable companies or organizations.
